The 13th Anniversary EIPTN Conference 2021 took place, as per Program below, on 22- 23 October 2021 at Carlos III University Madrid City Center Campus, Madrid, Spain, and gathered, in presence and online, IP Academics from the entire European Continent, as well as from North America and Japan. Also, as a result of its dynamic outcome, new Members joined the EIPTN Working Groups, and two Working Groups are preparing actively Publications that will be available online on our website. At the end of the Conference, Prof. Yolanda Bergel Sainz de Baranda, Carlos III University, Madrid, Spain, was elected as 7th Member of our EIPTN Committee.

The presentation made it possible to share the result of collective research fueled by containment. This work consisted in analyzing the contractual terms of use of several platforms used for online education and seeks the compatibility of these terms of use with the main essentials of copyright law on the one hand and higher education law on the other. This work, rich in dynamics, has made it possible to highlight the discrepancies between the UGC and academic practices. It was possible to question the difference in treatment according to whether access is organized by the university or by the teacher directly. This research has also shown the extent to which digital education platforms are transnational, while intellectual property issues, such as those related to the legal framework for education, remain national.

 

B- Academic teachers and copyright in Scandinavia

Ulrika Wennersten, Senior lecturer, School of Economics and Management, Lund University, Sweden

Professor Wennersten gave us an analysis of the legal framework in which a Swedish university professor could operate online. It emerged from this rich presentation that difficulties exist in fully articulating the issues of online teaching and those of the status of researcher, teacher, and possibly intellectual property rights on the teaching delivered, both for oral and written performance. The very sensitive issue of recording teaching for later use or use in different training courses also nourished the exchanges.

 

C- Legal issues on IP teaching, including teachers’ rights on their courses and recording of classes, and teachers’ rights and duties in general

Vishv Priya Kohli, Assistant Professor, Copenhagen Business School, Denmark

Dr. Vishv Priya Kohli shared her experience at a Danish university in dealing with the contemporary constraints of e-learning. In addition to an understanding of the technical tools, the pedagogical challenges of such a presentation of the law were presented, as well as the constraints linked to the rights of teacher-researchers over their productions. The Danish example, which was richly illustrated during this presentation, also made it possible to perceive common tensions or questions, whatever the country of origin of the teaching.

D- Data loss prevention policies and tools in solving legal issues in IP teaching in a digital environment

Miglena Molhova-Vladova, IP assistant professor in the Industrial business Department, University of National and World Economy, Sofia, Bulgaria

The presentation focused on teachers’ copyright and educational use of third-party copyright-protected content in the digital environment. The teacher’s role, the universities, and the universities’ use of teaching platforms were problematized. It was suggested that a solution could be Data loss prevention policies and tools at universities to solve the IP issues that arise with teaching in a digital environment.

 

E- The way forward in Europe

The presentation took the COVID19 pandemic as a starting point. The experience to move from face-to-face teaching to online teaching was discussed both from a teaching perspective and a student learning perspective. The following topics were highlighted:: interaction with the students, but also students´ possibilities to interact with each other, the possibility to challenge students thinking in an online environment and freedom of speech, how to build trust, the possibility of originality, quality and liberty in the design of the teaching, and the lack of controlled space, and platform security.

 

 

Session 3-   How to best perform online/distant/remote teaching and exams

F- Innovations in Teaching in Intellectual Property

Maureen O’Sullivan, Marianne Walsh, PhD candidate, NUI Galway 

The presentation focused on innovations implemented /to be implemented in connection to courses on IP at NUI Galway, including the use of video, discussion groups among students, possibly student-led seminars, skype consultations, list of self-test questions after each class which can be discussed in online forums without a staff presence, guest speakers. Limitations of technologies in that in the West of Ireland, broadband is not always robust and, therefore, recording of material and making it available after the class was considered important, though this also raises issues of ownership of the material. On the other hand, the experience of the examination process was very smooth as it was managed by a Law School administrator through Blackboard, and for once we were able to read all the writing.

 

G- Experiences in developing flipped learning ‘choose your own adventure’ video lectures 

Adrian Aronsson-Storrier, Associate Professor in Law and School Director of Teaching and Learning, School of Law, University of Reading.

This talk discussed the development of innovative ‘choose your own adventure’ video teaching materials for a new blended learning undergraduate law module at the University of Reading. Lecture content in the module is delivered by interactive flipped learning videos (created using Adobe Captivate). The flipped learning approach, involving online quiz sections and branching video paths, was inspired by the ‘Choose your own adventure’ children’s book series popular in the 1980s and the film Black Mirror: Bandersnatch.. Separately, the issue of diversity in the University Codes of Rights or Recording of Teaching was also discussed during this presentation.

H-  IP Law Summer School online – mission impossible? 2020 Kraków IP Law Summer School online edition

Anna Tischner– Professor at the IP Law Chair of the Jagiellonian University, Krakow, Poland

Olena Roguska– PhD Candidate at the IP Law Chair of the Jagiellonian University, Krakow, Poland 

This presentation described the switch from a well-established yearly week-long programme from in-presence to online: to enable the participants to interact and cooperate better, a team of school participants (lecturers and students) was created on Microsoft Teams platform. In addition to the content channels, file-sharing of materials, the Get Together channel was created, in which student volunteers took various initiatives to socialize and activate participants (e.g. presentations of geographical indications from the represented countries etc.). The 2020 topic “IP Quality” was completed by a workshop on „How to present and how to convince” and a workshop „on Getting Published in IP Law”, in order to make students aware of the importance of high-level publications on IP – both academic and professional. Though cumbersome in preparing it and making it operational, the Activity was successful thanks to a cautious organization, and offered the advantages of being affordable, getting a wider range of foreign lecturers, and offering accessibility for students from remote countries.

 

Session 5-  University and community spirit in distance activities: the image of the IP teacher versus the image of his institution in an online world

The Session, conducted in the form of a debate, focused on three issues:

the image of the University vs the image of the Professor in Students’ minds: means for reinforcing the feeling of identity to the University were considered, e.g. systematic use of University backgrounds when teaching

– the relationship between colleagues at a time of distancing: mixed feelings were expressed. Whereas in general there was a feeling of isolation, some colleagues found that new forms of Faculty solidarity were met, in particular in front of administrative requests from Universities that were not manageable in practice in distance teaching;

– interdisciplinarity: the online environment permitted, according to a few colleagues, to reinforcing interaction between colleagues and between various group groups of students who understand better respective expectations through chats than in face to face approaches where each group has the natural trend to be self-referential.

I- The EPO Academy’s Tools for IP Teaching

Ms. Giovanna Oddo, Programme Area Manager Academia, European Patent Academy, EPO presented the comprehensive Program developed by the EPO Academy, to support Universities, NPOs, TTOs, and Research Institutions, the training package on offer, and the EPO Academic Research program. She detailed, and replied to numerous positive comments and questions on the IP Teaching material, publications, recordings, videos, and articles developed by the EPO, and the vast e-learning offer developed.

 

J- EUIPO Academy’s Tools for IP Teaching

Mr. Javier Guillem Carrau, IP Specialist, EUIPO Academy, presented the EUIPO Academy’s vast online offer, IP Events, and the Online Portal developed (including a large variety of online courses, and weekly webinars) that raised similarly numerous positive comments and questions. It was underlined that both the EPO and EUIPO provide invaluable support to IP Teaching Activities in Europe.

 

K- AIPPI and IP education: potential synergies and opportunities for cooperation

Arno Hold, Executive Director, International Association for the Protection of Intellectual Property (AIPPI), presented the synergies between a global organization such as AIPPI and a European one such as EIPTN, as both work for better dissemination of IP in society. Educational activities conducted by AIPPI Members, as well as Resolutions adopted by AIPPI might serve as a basis for identifying common Projects.

 

L- 4iP Council’s experience in supporting IP Teaching

Axel Ferrazzini, 4iP Council EU Managing Director, explained that 4iP collaborates with Universities and Professors and industry representatives to explain the roles of IPRs to students, Key stakeholders of the IP ecosystem to bring the most comprehensive content to entrepreneurs, start-ups and SMEs, Teachers to present IP business case studies, Events organisers to explain the what, why, how of IPRs. By doing so it developed graphics, infographics, case studies, Interactive Guides, support to publications on IP, and a Yearly 4iP Research Award open to LL.M and PhD students, offering therefore a vast array of tools and options to the European Teaching Community, largely cooperating with this Organization. Numerous positive comments and questions were raised on upcoming products.

 

Special International Session focused on How European IP Teaching Is Perceived in Other Continents

Pr. Irene Calboli, Professor of Law at Texas A&M University School of Law, Academic Fellow at the School of Law, University of Geneva, Fellow at Melbourne Law School, Visiting Professor, Nanyang Business School, Nanyang Technological University, and Transatlantic Technology Law Fellow at Stanford University, stressed the importance of the fact that in Europe Universities teach continental law as well as common law, representing, therefore, a form of authoritativeness in the rest of the world. Also, as IP is globalized, other parts of the world need therefore to consider, for comparative purposes, the work of European IP Scholars.

Session Moderators: all EIPTN Committee members

1– developments in the work of the EIPTN Working Groups (http://www.eiptn.eu/working-groups/): the Chair reported that several of the EIPTN Working Groups are embarking in developing initiatives and publications or group supported-publications. He encouraged EIPTN Members to join Working Groups so that they develop as many activities as possible.
2– the Proposal for the creation of an EIPTN Working Group on “Teaching IP and International Economic Law (Trade and Investment)”, presented by Gabriele Gagliani, Lecturer, Bocconi University & Adjunct Professor, Case Western Reserve University School of Law, USA, and approved by the EIPTN Committee was welcomed warmly by the Open Committee Meeting.

3– the Way Forward for EIPTN: among the initiatives to develop before the 2021 Session, the Chair welcomed all possible initiatives that would permit to develop publications for EIPTN, or EIPTN-supported publications. Also, he encouraged Members to alert EIPTN on initiatives and webinars that could be announced and supported in-between our annual meetings. These proposals received support from participants.

The EPO and EUIPO who were also duly thanked on many occasions during the Conference for their support to EIPTN, were duly greeted, jointly with all EIPTN supporters.

 

In conclusion, the Chair warmly thanked Carlos III University for the support in organizing the Online 2020 Conference and preparing actively with the Committee Members who he also warmly thanked, the 2021 Annual Conference in Madrid (date TBD), leaving the final word to Sara Martin Salamanca, Professor of Law, Vice-Rector for Research, Carlos III University of Madrid, who expressed her recognition for Carlos III University, a leading young European University, being chosen for organizing the 2021 EIPTN Annual Conference.

EIPTN 12th Worldwide Annual Conference

23-24 October 2020

Dear Intellectual Property Academic,

You are cordially invited to participate in the 12th-anniversary conference of the European Intellectual Property Teachers’ Network (EIPTN), to be held online on 23-24 October 2020.

About EIPTN

EIPTN is multi-disciplinary in focus and aims to bring together intellectual property law (IP) teachers from across Europe to exchange ideas on best practices in IP teaching and learning activities.

In particular, EIPTN aims to raise awareness and disseminate information relating to:

  • innovation in the teaching of IP
  • problem-based teaching and learning
  • multi-disciplinary teaching and learning
  • promotion of  IP teaching through IP professionals (i.e. patent attorneys, trade mark attorneys and technology transfer offices staff)

The European Patent Academy of the European Patent Office (EPO) and the Academy of the European Union Intellectual Property Office (EUIPO) support the EIPTN Annual Conference since 2007.

Conference 2020:  online format

Originally, our 2020 Annual Conference was to be hosted by Carlos III University, Madrid, Spain, in June. Due to the health situation in Europe, these plans had to be cancelled even before the Call was published (announcement on this on our website www.eiptn.eu).

Therefore, the EIPTN Organizing Committee decided that our 2020 Annual Conference would take place online, on 23 and 24 October 2020.

Yet, Carlos III University kindly confirmed that they would host our next face to face Annual Conference, in 2021.

 

12th Anniversary Theme – Intellectual Property Teaching in the Post-Covid World

In the IP teaching and research community in Europe, there is a reviving interest in improving IP teaching, a topic sometimes neglected in the past by academics under pressure to deliver research results. Furthermore the area of IP pedagogical research is becoming more widely recognized.

As anticipated at our 2018 Conference, teaching techniques are rapidly evolving, and the COVID19 pandemic has exponentially accelerated existing trends of massive use of technological tools in teaching. Therefore, the central theme of the 12th Anniversary of our Network is Intellectual Property Teaching in the Post-Covid World.  

 

Focus of our Call for Abstracts

The IP Teaching Agenda is profoundly re-shaped by the emergence of online/distant/remote teaching. This evolution, much and suddenly accelerated by the pandemic, raises considerable questions in the IP teaching community, and considerable interest. Hence, this year our Call for Abstracts focuses on:

  • a-how to best perform online/distant/remote teaching and exams: indeed, many colleagues need help and support to better identify best practices, suitable platforms, new methods for class exercises and participation, etc.;
  • b-legal Issues on IP teaching, including teachers’ rights on their courses and teachers’ rights and duties in general, recording of classes, freedom of speech of IP teachers, students’ exams, students’ rights, University codes of rights;
  • c-university and community spirit in distance activities: the image of the teacher versus the image of his institution in an online world;
  • d-distance summer programs.

 

Abstracts selection priorities

Since our last Annual Conference, and in particular over spring and summer 2020, a large amount of webinars and events have already taken place in the EU, in the UK, and elsewhere in the world. These events have covered item (a) above (how to best perform online/distant/remote teaching and exams) above, including with the support of EIPTN. By October 2020, it is likely that much presentations will already exist on this item.

Abstracts selection would therefore focus first on topics

 – (b) legal Issues on IP teaching, including teachers’ rights on their courses and teachers’ rights and duties in general, recording of classes, freedom of speech of IP teachers, students’ exams, students’ rights, University codes of rights

and

– (c) university and community spirit in distance activities: the image of the teacher versus the image of his institution in an online world

that are still largely uncovered,

together with a thematic approach on item (d) (distance summer programs) and innovative scenarios for item (a).

 

Given the informal nature of the conference, we do not expect selected speakers to prepare a full paper to present at the conference.  Instead, we are issuing this call for proposals asking participants to give 20-minute presentations (plus Q&A) on issues relating to IP teaching experiences.  We would encourage you to provide feedback from the students or evidence of any impact on teaching outcomes due to the issues discussed.  Examples of presentations given at the Annual Conferences in previous years can be found on the EIPTN website at www.eiptn.eu

Please note that, as per traditional practice at our Annual Conferences, the EPO and EUIPO will also be invited to hold a ‘best practice’ session devoted to illustrating and discussing the IP teaching materials they have developed, in particular online tools that facilitate the work of Academics. Also, the EIPTN Thematic Working Groups will present the status of their activities since our last Conference.

 

How to get involved in the 2020 EIPTN Online Annual Conference  

The working language of the Annual Conference is English.

If you would like to participate in the EIPTN 12th Anniversary Conference 2020 by giving a short presentation on one of the above items, please send the title of your proposed presentation and a 500-word abstract to:  info@eiptn.eu

The deadline to send abstracts is 7 September 2020. The EIPTN Committee will then select abstracts based on their innovative character and potential contribution to the teaching of IP.

Under its traditionally dynamic orientations, EIPTN wishes to enlarge and extend its membership basis. To this end, contributions are encouraged not only from European IP teachers but also from young IP researchers and from public organizations engaged in IP teaching activities. In this respect, non-EIPTN members are welcome. One or more special sessions will be dedicated to their presentations.

 

Other Conference Delegates

We welcome delegates who are IP teachers and IP professionals (e.g. patent and trademark attorneys, technology transfer offices staff, scientific researchers) to attend EIPTN 2020 without giving a presentation: they will get full access to online debates.

 

2020 EIPTN Online Annual Conference Programme

Notification of the programme of the annual Conference and further details about how to register for the event if you are not a speaker will be sent once all abstracts are selected.  We confirm that the “formal” Annual Conference will take place on 23-24 October 2020, with a special session on the morning of 24 October for young Researchers /Academics.

 

Publication of Conference Papers

Details on possible publication opportunities will be given once abstracts are selected and depending on the quality of both abstracts and presentations.
